Compensation Claims – Reasons To Make One

Over recent years, the number of compensation claims made has been dramatically increasing. The reason behind this has been because of the popularity of companies that offer no win no fee contracts. What this basically means is that after a vetting process in which a claimant will communicate with a solicitor, lawyer or other legal entity from a particular company, to estimate the chances of success, a contract will be offered for the company to pursue the case on the claimants behalf and if the claim is rejected, then the company will not require payment.

It is often said that the most common forms of personal compensation claims are caused by personal injuries sustained either at a place of employment or in a public environment. As much as 36% of all compensation claims made against businesses are due to injuries caused by a trip or fall in the workplace. What this has meant is that the cost of public liability insurance cover that all businesses must provide, by law, has increased dramatically. In certain sectors, this has seriously affected small and medium sized companies, as if a large proportion of a company’s workforce are employed for manual labor, the public liability insurance costs can end up being financially crippling.

What this streamlining of claim process has lead to is a society that feels that the big corporations owe them something, and that something can be obtained if they play the system right. Personal injury lawyers are constantly advertising on television and in magazines for you to contact them if you have been caused any injury at all due to your employment. Now, in many situations, if you have experienced an injury which was directly caused by improper training or negligence on behalf of your employer, then a claim is justified; but unfortunately what we have been seeing is an increase in the amount of falsified injury claims or exaggerated injuries that enable somebody to get money effectively for nothing.

By far the most common causes of personal injury compensation claims are from road traffic accidents. By law, every vehicle that is driven on public roads must have valid 3rd party insurance. What this means is that if an accident occurs, the person who is attributed blame and is ultimately the cause of the accident must cover the costs of repair and compensation through their insurance cover. As the process for claiming personal injury compensation is so simple, it almost encourages people to exaggerate injuries to increase compensation payouts, though that is not to say that some people do not deserve large payouts from their injuries.
